01 Acceptance of Terms

By accessing, registering on, or using any part of the 5 BMW platform (accessible at 5-bmw.app), you ("the User," "you," or "your") acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions ("Terms"), together with our Privacy Policy and Responsible Gaming Policy, all of which are incorporated herein by reference.

If you do not agree with any part of these Terms, you must immediately cease using the 5 BMW platform. Continued use of the platform following any update to these Terms constitutes your acceptance of the revised Terms.

02 Eligibility

To register and use the 5 BMW platform, you must satisfy all of the following eligibility requirements:

• You are at least 21 years of age, in compliance with Philippine gaming regulations governing online gambling;
• You are accessing the platform from a jurisdiction where online gambling is legal and not prohibited by applicable law;
• You are not a resident of any jurisdiction where the use of online gambling services is restricted or prohibited;
• You are acting on your own behalf and not as an agent for any third party;
• You have not previously been excluded from 5 BMW or any affiliated platform;
• You are not a current employee, contractor, or immediate family member of an employee of 5 BMW or its affiliated companies.

5 BMW reserves the right to request documentary proof of age and identity at any time. Failure to provide satisfactory documentation may result in suspension or permanent closure of your account and forfeiture of any pending withdrawals pending investigation.

03 Account Registration

Each individual may hold only one (1) registered account on the 5 BMW platform. The creation of multiple accounts by the same individual is strictly prohibited and may result in the suspension of all associated accounts and forfeiture of balances.

When registering, you agree to:

• Provide accurate, current, and complete information as required by the registration form;
• Maintain and promptly update your account information to keep it accurate and complete;
• Keep your 5 BMW Login credentials (username and password) strictly confidential;
• Notify 5 BMW immediately upon becoming aware of any unauthorized use of your account or any other breach of security;
• Accept full responsibility for all activities that occur under your account.

5 BMW will never contact you to request your password. Any communication purporting to be from 5 BMW that requests your login credentials should be treated as fraudulent and reported to our support team immediately.

04 Deposits & Withdrawals

All financial transactions on the 5 BMW platform are denominated in Philippine Peso (₱ / PHP). 5 BMW supports the following payment methods for Filipino players: GCash, PayMaya, BPI, BDO, and Metrobank.

Deposits:

• Minimum deposit: ₱10. Maximum deposit limits may apply depending on your account verification level.
• Deposits are credited to your 5 BMW account instantly upon confirmation from the payment provider.
• 5 BMW does not charge fees on deposits; however, your payment provider may apply their own transaction fees.

Withdrawals:

• Minimum withdrawal: ₱100. Maximum withdrawal limits may apply per transaction and per day.
• Withdrawals are processed within 5 minutes under normal operating conditions via GCash and PayMaya.
• Bank transfers to BPI, BDO, and Metrobank may take 1–3 banking days depending on the receiving institution.
• Withdrawals will only be processed to the same payment method used for the original deposit, subject to anti-money laundering compliance requirements.
• 5 BMW reserves the right to request identity verification documents before processing any withdrawal.
• Bonus funds and winnings derived from bonus funds are subject to wagering requirements before withdrawal is permitted.

05 Bonuses & Promotions

5 BMW offers various promotional incentives including welcome bonuses, reload bonuses, cashback offers, and event-based promotions tied to Philippine holidays and major sporting events such as PBA playoffs, NBA Finals, and international boxing matches. All bonuses are subject to the following general conditions:

• Each bonus offer carries specific wagering requirements that must be fulfilled before any bonus-derived winnings may be withdrawn. Wagering requirements are stated in the individual promotion's terms.
• Bonuses are credited to a separate bonus wallet and are applied to eligible games only. Not all games contribute equally to wagering requirements.
• Only one bonus may be active at a time unless otherwise stated in the promotion's specific terms.
• 5 BMW reserves the right to modify, suspend, or withdraw any promotion at any time without prior notice.
• Bonuses obtained through fraudulent means, including the use of multiple accounts, will be voided and the associated account suspended.
• Bonuses are non-transferable and have no cash value until wagering requirements are fully met.

06 Game Rules & Fairness

All games available on the 5 BMW platform — including slots, live baccarat, roulette, bingo, mines, and game shows — are provided by certified third-party game providers. Each game operates using a certified Random Number Generator (RNG) that has been independently audited to ensure fair and unpredictable outcomes.

• Game results are final once confirmed by the game server. In the event of a technical malfunction during a game round, 5 BMW reserves the right to void the affected round and refund the wager to the player's account.
• Return-to-Player (RTP) percentages vary by game and are disclosed within each game's information panel.
• 5 BMW does not manipulate game outcomes. All results are determined solely by the certified RNG systems of our game providers.
• In the event of a discrepancy between the result displayed on your device and the result recorded on the game server, the server record shall be deemed authoritative.

07 Prohibited Conduct

The following activities are strictly prohibited on the 5 BMW platform. Engaging in any prohibited conduct may result in immediate account suspension, permanent ban, and forfeiture of all account balances:

• Fraud and Misrepresentation: Providing false information during registration or at any other time, including false identity documents.
• Multiple Accounts: Creating or operating more than one account, whether under your own name or using another person's identity.
• Collusion: Coordinating with other players to gain an unfair advantage in any game, particularly in live dealer games.
• Automated Software: Using bots, scripts, artificial intelligence tools, or any automated software to interact with the platform or gain an advantage in any game.
• Chargebacks: Initiating unauthorized chargebacks or payment reversals through your bank or e-wallet provider.
• Money Laundering: Using the 5 BMW platform to launder money or conduct any transaction that violates Philippine anti-money laundering laws.
• Exploitation of Errors: Deliberately exploiting software bugs, errors, or glitches to gain an unfair advantage. Any winnings obtained through exploitation of errors will be voided.
• Harassment: Engaging in abusive, threatening, or harassing behavior toward other players or 5 BMW staff.

08 Intellectual Property

All content on the 5 BMW platform — including but not limited to the 5 BMW brand name, logo, website design, graphics, text, game interfaces, software, and promotional materials — is the exclusive intellectual property of 5 BMW or its licensed content providers and is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the 5 BMW platform solely for personal, non-commercial entertainment purposes. You may not:

• Copy, reproduce, distribute, or publicly display any content from the 5 BMW platform without prior written consent;
• Modify, adapt, translate, or create derivative works based on any 5 BMW content;
• Use any 5 BMW trademarks, logos, or brand elements in any manner that could cause confusion or imply endorsement;
• Reverse-engineer, decompile, or disassemble any software used in connection with the 5 BMW platform.

09 Privacy & Data

5 BMW collects, processes, and stores personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the 5 BMW platform, you consent to the collection and use of your personal information as described in the Privacy Policy.

Key data practices include:

• Personal data collected during registration and verification is used solely for account management, identity verification, and regulatory compliance purposes.
• Transaction data is retained for a minimum period as required by Philippine financial regulations and anti-money laundering laws.
• 5 BMW does not sell your personal data to third parties for marketing purposes.
• You have the right to request access to, correction of, or deletion of your personal data, subject to legal retention requirements.

10 Responsible Gaming

5 BMW is committed to promoting responsible gaming practices. We recognize that gambling can become harmful for some individuals, and we provide a range of tools to help players maintain control over their gaming activity.

The following responsible gaming tools are available to all registered 5 BMW players:

• Deposit Limits: Set daily, weekly, or monthly deposit limits to control your spending. Limits take effect immediately when reduced and after a 24-hour cooling-off period when increased.

11 Limitation of Liability

To the fullest extent permitted by applicable law, 5 BMW, its directors, officers, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the platform, including but not limited to:

• Loss of funds resulting from gambling activity on the platform;
• Interruption, suspension, or termination of the platform or any game;
• Unauthorized access to or alteration of your account or data;
• Technical errors, server downtime, or connectivity issues beyond 5 BMW's reasonable control;
• Any reliance placed on information or content published on the 5 BMW platform.

5 BMW provides the platform on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, 5 BMW's liability shall be limited to the maximum extent permitted by law.

12 Termination

5 BMW reserves the right to suspend, restrict, or permanently close any user account at its sole discretion, with or without prior notice, for reasons including but not limited to:

• Breach of any provision of these Terms & Conditions;
• Suspected fraudulent, illegal, or abusive activity;
• Failure to satisfy identity or age verification requirements;
• Regulatory or legal requirements;
• Extended periods of account inactivity (accounts inactive for more than 12 consecutive months may be subject to dormancy procedures).

Upon termination for cause, 5 BMW reserves the right to forfeit any remaining balance in the account if it is determined that the balance was obtained through prohibited conduct. In all other cases of account closure, any verified real-money balance will be returned to the player via their registered payment method after completion of any required verification procedures.

13 Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the competent courts of the Philippines.

5 BMW operates in compliance with applicable Philippine gaming regulations. Players are responsible for ensuring that their use of the platform complies with the laws of their own jurisdiction.

14 Amendments

5 BMW reserves the right to amend, update, or replace these Terms & Conditions at any time. When material changes are made, 5 BMW will notify registered users via email or an in-platform notification at least 7 days before the changes take effect, where reasonably practicable.

The most current version of these Terms will always be available on this page, along with the effective date and version number. Your continued use of the 5 BMW platform after the effective date of any amendment constitutes your acceptance of the revised Terms.

If you do not agree with any amended Terms, you must stop using the platform and may request account closure by contacting our support team.
